Terms of Service

1. Who we are and what you agree to

AQUACORE.AI ("we", "the Service") is a platform made up of four web applications for aquatic sports performance: ACore Athlete, ACore Coach, ACore Triathlete and ACore Open Water.

The Service is operated by Daniel Rogati, an individual, contactable at rogatidaniel@gmail.com.

By using any of the Apps, you agree to these Terms of Service. If you do not agree to them, do not use the Service.

2. Who can use the Service

You must be at least 18 years old to create an account on AQUACORE.AI. If you are a coach using ACore Coach to manage minor athletes, you declare that you have the right and the necessary consent to enter their data into the platform (see also our Privacy Policy, section 2.4).

3. Your account

You are responsible for keeping your login credentials secure
You are responsible for the accuracy of the data you enter (times, distances, personal bests)
You agree not to share your account with third parties or use it for unlawful purposes

4. Pro subscriptions and payments

Each App has a free plan with limited features and a paid Pro plan
Payments are handled by Lemon Squeezy, which acts as Merchant of Record — specific payment, billing and refund terms are also governed by Lemon Squeezy's own conditions
Subscriptions renew automatically unless cancelled
If you cancel your subscription, access to Pro features remains active until the end of the already-paid period
Prices may change; any changes will be communicated to you in advance

5. GPS Safety Feature (ACore Open Water)

If you activate the real-time GPS location sharing feature on ACore Open Water:

You understand that this feature is a safety support tool, not a guaranteed rescue system or a professional emergency service
AQUACORE.AI does not replace normal water safety precautions or official rescue services (coast guard, lifeguards, emergency numbers)
The availability and accuracy of the feature depends on your device's internet connection and GPS, which we cannot guarantee 100%
Use of this feature is at your own risk; we recommend not relying exclusively on it for your safety in open water

6. Sports data and user-generated content

The training data you enter (times, sessions, notes) remains yours. You grant us a limited license to process this data solely to provide you with the Service. We do not claim ownership of your sports data.

7. What you may not do

Use the Service for unlawful purposes
Attempt to access other users' data without authorization
Decompile, modify, or attempt to extract the application's source code
Use the Service to send spam or harmful content to other users (e.g. via ACore Coach towards athletes)

8. Limitation of liability

The Service is provided "as is". We do not guarantee that the training zone calculations or Training 2.0 plans are suitable for every individual's physical condition — always consult a professional (doctor, certified coach) before following an intensive training plan. We also do not guarantee uninterrupted availability, or that the GPS safety feature will work under all conditions (see section 5).

To the extent permitted by law, we are not liable for indirect damages arising from the use of the Service, including sports injuries, accidents in water, or data loss.

9. Changes to the Service

We may modify, suspend, or discontinue features of the Service at any time, especially during this active development phase. We will try to give advance notice of material changes that reduce already-purchased Pro features.

10. Account cancellation

You may cancel your account at any time by contacting rogatidaniel@gmail.com. We reserve the right to suspend or cancel accounts that violate these Terms.

11. Governing law

These Terms are governed by Italian law. For any dispute, the competent court is that of the Service's controller, subject to any non-waivable consumer rights provided by law.

12. Changes to these Terms

We may update these Terms of Service. Material changes will be communicated to you via the app or by email before they take effect.
